By creating an account or using HomeworkTurtle, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the Service.
If you're under 18, your parent or guardian must agree on your behalf. If you're under 13, your parent or guardian must complete the verifiable parental consent flow described in our Privacy Policy before you can use the Service.
HomeworkTurtle is a digital tool that helps students track homework, take notes, generate study materials, get explanations from an AI tutor, and stay focused. We offer the Service on a freemium basis: a Free tier with limited AI usage, and paid Student and Family subscriptions with higher usage limits. (School and district licensing is planned — interested schools can contact support@homeworkturtle.com with "SCHOOLS" in the subject.)
The Service is not a substitute for a teacher, a parent, or professional advice. We don't guarantee any educational outcome.
Availability. The Service is offered only to users located in the United States. We do not direct the Service to, and do not knowingly accept accounts from, users outside the United States, and we make no representation that the Service is appropriate or available for use elsewhere. If you use the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
To use most of the Service you need an account. You agree to provide accurate information at signup, keep your password confidential, and use only one account per person. Tell us immediately if you suspect your account is being used without permission.
You can delete your account from in-app Settings → Privacy & Data → "Delete Account" on any platform. Deletion is permanent and cascades to your homework, notes, files, subscriptions, and related records. Some records — like billing and audit logs — may be retained for a limited time for legal, tax, or fraud-prevention purposes; see our Privacy Policy.
Free week for new accounts. Eligible accounts receive one complimentary week of the Student plan (the Family plan for parent accounts). The week starts automatically the first time the account is opened in any HomeworkTurtle app or on the website after sign-up (for accounts under 13, after a parent gives consent), and lasts 7 days from that moment. No payment method is collected, nothing is charged, and it never turns into a paid subscription on its own: when the week ends the account returns to the Free plan unless you choose to subscribe, and everything you created stays in your account. The free week is limited to one per person. Accounts that are already subscribed, covered by a Family plan, or have previously subscribed or used the subscriber free trial are not eligible, and we treat accounts using variations of the same email address as the same person. It is separate from, and does not use up, the subscriber free trial described below. We may decline, end early, or withdraw a free week that we reasonably believe was obtained through duplicate accounts or other abuse, and we may change or end this offer for new accounts at any time.
Free trial. New subscribers may be offered a 7-day free trial of the Student, Family or Parent+ plan. A payment method is collected when the trial starts, nothing is charged during the trial, and the first charge ($4.99 for Student, $9.99 for Family, $14.99 for Parent+) occurs automatically when the trial ends unless you cancel before then. One free trial per account, across all plans and on every platform — a trial started on the web and one started through the App Store count as the same trial. Customers who have previously subscribed are not eligible. We may change or end the trial offer at any time for new subscribers.
Prices may change. We will notify you of any price change at least 30 days before it takes effect for existing subscribers.
iOS, iPadOS, and macOS apps (purchased through the App Store): payment is processed by Apple. Cancellation, refunds, and subscription management are handled by Apple in Settings → Apple ID → Subscriptions.
Web and Windows app: payment is processed by Stripe. You can manage your subscription through the Stripe billing portal linked in the Plans tab.
We do not see your full payment card number.
Paid subscriptions auto-renew at the end of each billing period at the then-current price until cancelled. You can cancel auto-renewal at any time — for Apple purchases in Settings → Apple ID → Subscriptions, and for Stripe purchases in the billing portal linked in the Plans tab — and cancellation takes effect at the end of the current period. Where required by law, we will send renewal or price-change reminders before a renewal is charged.
Apple-paid subscriptions: refunds are handled by Apple. Stripe-paid subscriptions: we offer pro-rated refunds for the unused portion of a billing period if you cancel within the first 14 days. After 14 days, you can cancel future renewals but the current period's charge is not refundable except where required by law.
When a paid subscriber exhausts their monthly Sonnet model AI quota, we route additional AI requests for the remainder of the month through a lighter (Haiku) model. We notify the user in-app via a badge on the Plans tab. This is intentional and is part of the Service.
You agree NOT to:
We may remove content, suspend accounts, or terminate access without notice for violations.
You keep ownership. You own the homework, notes, AI conversations, and files you create or upload to HomeworkTurtle. We don't claim ownership.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your content only as needed to provide the Service to you. This license ends when you delete the content or delete your account.
If you upload a file used by an AI feature, a copy is sent to our AI provider (Anthropic) for processing as described in our Privacy Policy. Anthropic's standard terms do not permit them to train on customer data.
AI responses are generated by Anthropic's Claude model. We don't guarantee the accuracy, completeness, or appropriateness of AI responses. AI responses can be wrong; treat them as a study aid, not a source of truth. You're responsible for how you use AI-generated content.
If you see content that violates these Terms or that you believe is unsafe, use the Report a Problem flow in Settings → Privacy & Data on any platform. AI tutor responses can also be reported in-line from the chat bubble. We review reports and may remove content, suspend accounts, or take other action consistent with our policies.
You can terminate at any time by deleting your account. We may suspend or terminate your account immediately for breach of these Terms or if required by law. Sections that should reasonably survive (ownership, disclaimers, indemnification, limitation of liability, dispute resolution, governing law) survive termination.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim, to the maximum extent permitted by applicable law, all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AI responses can be wrong; relying on them is at your own risk.
To the maximum extent permitted by applicable law:
Some jurisdictions don't allow these limitations; in those jurisdictions, the limitations apply to the maximum extent permitted by law.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles.
Binding individual arbitration. You and Oddball Outpost LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small claims court. The AAA’s rules and forms are available at www.adr.org. Arbitration may proceed by videoconference or, if an in-person hearing is required, in the county where you live or another mutually agreed location.
Class action and jury waiver. You and we each waive the right to a jury trial and the right to participate in a class, collective, or representative action. The arbitrator may award relief only on an individual basis.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@homeworkturtle.com from your account email with a clear statement that you wish to opt out of arbitration, within 30 days of first creating your account (or, for existing users, within 30 days of these Terms taking effect). Opting out does not affect any other part of these Terms.
We may update these Terms from time to time. For material changes, we'll notify you in-app and by email at least 30 days before the change takes effect. If you don't agree to the new Terms, your only remedy is to stop using the Service and delete your account before the new Terms take effect.
To the maximum extent permitted by law, you agree to indemnify and hold harmless Oddball Outpost LLC and its officers, employees, and contractors from third-party claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law. If you are a parent or guardian who agreed on behalf of a minor, this applies to use of the Service under your account. This section does not require you to indemnify us for our own negligence or misconduct, and it does not apply where prohibited by law.
We respond to notices of alleged copyright infringement. If you believe content on the Service infringes your copyright, send a notice to privacy@homeworkturtle.com (attn: Copyright Agent) including: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and where it is located; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act; and your physical or electronic signature. We will remove or disable access to infringing material and, where appropriate, terminate repeat infringers. If your content was removed by mistake, you may submit a counter-notice to the same address.
If you obtained the app from the Apple App Store, the following also applies and controls in case of conflict for that app:
You agree to comply with all applicable export-control and sanctions laws. You may not use the Service if you are located in, or are a national or resident of, an embargoed jurisdiction, or if you appear on a denied-party or sanctions list.
We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, network or infrastructure-provider outages, war, terrorism, labor disputes, or government action.
Severability: If any provision is held unenforceable, the rest stays in effect.
No waiver: A failure to enforce any part of these Terms isn't a waiver.
Assignment: You can't assign these Terms without our written consent.
Entire agreement: These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
